FMV assessment needed broken Honda Muffler

So I was out with friends at mineral wells last weekend... and this muffler broke off the exhaust on one of the S2000's... 

He didn't want it and so I asked to try and take it and attempt to use it and the guy was all for it. 

Here's where it broke from the Y pipe..

damage it did as it came loose. 

I literally got it for free, may or may not use it on hazmat. But want to determine a FMV case I/we decide to..

Would he have left it in the dumpster if you hadn't put it in your truck?

Yep. He didnt have room for it and the exhaust came on the car and he wants something new. I confirmed multiple times after he thought about it for a bit and kept driving with only one muffler. 

Then free in the budget

I second as free but a good challenger would have asked if they could unbolt the pipe from the car to reweld.

We tried but it was seized and I'm not going for it after the fact. 

I would say found on road as he would have left it there if he were alone.
