Ever read the Clean Air Act? Anything that changes the oem gas mileage of a vehicle is already illegal. Not enforced, but it's on the books. Tires, exhausts, tire pressure, type of wax, etc.
Sometimes some of the interesting folk on the other side of the wall from me get worked up over this and consider trying to enforce it.

Back when I was a newspaper reporter I covered the AZ state legislature for a while. Wrote a lengthy story once on the ridiculous bills and behavior of that particular session and managed to piss off pretty much everyone. The stuff politicians waste time and money arguing over is just mind-boggling. I don't remember all the details of that particular story, but I do recall a lengthy debate over the Arizona state dinosaur.
These assclowns here in SC have argued over the state drink (milk), state insect, you name it. Problem is this crap has NOTHING to do with budget shortfalls, substandard bridges, school buses that burn, stuff like that. Fixing that kind of thing is just too much like work.

Even if it improves it. For instance, if a vehicle was only available from the factory in a single exhaust configuration that means to cut the exhaust off past the factory catalysts and run duals is illegal. A huge single pipe is legal.

Understood. I was giving an example of what I consider to be an intelligent law. This does not make all laws intelligent, it merely proves that they exist.
I suspect the law was aimed at people putting 20 to 32 inch rims on Escalades, Hummers and assorted hoopties.
One of my old coworkers used say, "They haven't repealed the law of unintended consequences just for us", when we were considering making changes to an existing process in the company. It definitely applies here.

Clean Air Resources Board (CARB) are the ones who approve aftermarket parts and issue the little "legal" stickers (like you get with K&N intakes or MSD coils for example). Most aftermarket items are approved by them, including tires. A lot are not, however the only state that cares is Cali and even then only on new-ish stuff. Washington for example has a 20 or 25 year rolling exemption on cars, the kicker is they only test in Seattle. So all of us in the rest of the state get a free pass on everything no matter what the Clean Air act thinks.

Yeah, AFAIK engine swaps in Cali are legal only if:
the engine was originally CARB certified. The JDM motors were never CARB certified so no go;
the vehicle passes an emissions test based on whichever CARB certified item is newer, the engine or the vehicle;
or the swap uses an alternative fuel only (alcohol, propane, etc). I read an article several years ago about a guy who did just that, he set his blown big block Mopar up to run strictly on methanol and he did not have to pass the exhaust sniffer test.
There's a lot of rumbling in the motorcycle community about proposed legislation which would make it illegal to use any sort of aftermarket exhaust on a motorcycle licensed for street use. Off road use would not be affected. One problem with that is the proposed legislation would use existing European noise standards which are allegedly much stricter than US noise standards. It would also give the motorcycle manufacturers an absolute lock on the replacement exhaust business.
