Looks like Ferrari guy was trying to avoid getting run-over by a left-turning truck driver who wasn't paying attention.

No skid marks either so it looks like a pretty slow-speed accident. Any faster, though, and I'd bet that LF wheel would have been the driver's seat.

Yep. It probably varies by state, but it can go from "not your fault" to "Partially your fault" if you break a law during the accident, even if you are trying to avoid the crash. If no witnesses can be found, it gets even worse. Unless the Ferrari's insurance argues that the car was knocked over the line during the accident, the truck's insurance will probably argue Ferrari was driving in a reckless manner, as evidenced by the photos showing it on the wrong side of the road.

It happened to my wife.
