Not is you want your friend to lose his license. Seriously just walk away, its not worth the heartache that you are giving yourself. Dealers and auctions have the legal standing to do this. It happens all the time and to them it is a non issue.

Lynnway AA is not really an affiliate of Manheim. They are just a small Independent. Smaller independent auctions don't really follow all the NAAA rules to a tee, and they're more of the good ole boy network. Sellers list a car on OVE etc, for a floor price and then they realize that they sold it for way less than they wanted. It happens all the time. In the larger Auctions like Manheim and Adesa, it is frowned upon. You pretty much only can ARB if you had wired the funds and the seller hasn't delivered. Also, Auctions don't like cars listed on buy it now and then sold outside the auction in the dealerships. They don't get the facilitation fees. BTW, I work for the Manheim Corp Office.

Well, I may have found another car. Almost exactly the same spec, this one has 17" wheels vs 18" wheels, is covered under CPO warranty for another 5 months but doesn't have the BMW maintenance.

This one is at a BMW dealer in CT. High asking price tho, my wholesaler friend is going to call them tomorrow and see what he can do for me...

How did the auction sell the car if it wasn't on their property? My experience with auto auctions in the North East is no car, no sale. Most auctions will hold both parties to their commitments on buying and selling. If you attempt to back out, don't come back again. The auction house has a stake in this, too. It's their reputation that the car is for sale and you bought it.

BMW of Darien. Just found another one in NY.

patgizz, this is where the cars are. I'm not trying to find New England cars. BMW didn't make very many of them and it's not like I'm buying a new one, so I just have to deal with where they are.

You're probably going to scoff but BMWs don't rust.

One of the reasons I keep thinking about E46s is that they simply do not rust. They leak various fluids and are bad to randomly ingest all of the oil in a matter of seconds and some maintenance items are expensive... but they don't rust.
