Damn dude that sucks. Glad no one was seriously hurt.

Former coworker of mine had his house totaled by a drunk driver. Guy was plastered at like 3 in the afternoon and allegedly nailed the house doing like 60-70 mph, with an empty 5th of Jack on the passenger seat. The dipE36 M3 then managed to walk away without a scratch, somehow, much to the chagrin of my coworker. In the end, I think he ended up living with his son for the better part of a year while he got a new house built.

Damn,

completely different ball of wax, but I have recent homeowners claim from a plumbing flood. $40k in damage, insurance company has been pretty good and reasonable. Aside from the inconvenience, I think our house will come out better than when we started. With mine, we got estimates. They issue a check to you(as well as your mortgage company if you have one) for about 85% of the estimate. You are then required to have an inspection to verify that the work was actually done, and you didn't use the money to buy a new fishing boat or something stupid, then they pay the remainder minus your deductible. Aside from the delay from our mortgage holder to sign off on the big check, it's been pretty pain free....you know beside having half your house flooded. That and all the house furnishings and stuff having to come out and take up space in my hours old new 4 bay garage that I've waited a decade to build....and now has to wait to have cars in it.

In reply to fireball123: Sorry to see that, considering the damage and there doesn't look to be any skid marks, probably a full speed hit. Could very well have been a sleep. Drunks usually slam on the brakes at the last minute. Was that because she was tired or drunk? I would check with police. If she was cited for dd or drugs, I have had really good luck getting exactly what I want from the other persons insurance company.

Drunk lady hit my honda once, I was driving an awd benz for 3 months while they tracked down the proper parts to fix my pilot. They said due to age and law they were authorized to use used parts, I said ok. Mechanic had 4 different rears sent in from various yards before he got one that wasn't a rusted piece of s. would have been cheaper to just buy new parts. Dumb A's.

If there driver was under the influence they tend to be very helpful and understanding. It helps them to not have lawyers chasing them.

Before agreeing to anything you may want to get an independent assurer involved. And not just go by what the insurance appraisers think needs to be repaired. It sucks trying to get them to deal with anything after the fact. Get it all up front even if you don't think the shingles were affected, easier now than after first freeze thaw cycle.

Car hit my house in NJ in the middle of the night (drunk driver). The squealing tires woke me, car came across 2 yards, took out 2 small trees in the neighbors perfect yard, hit a huge bush before hitting the corner foundation. Knocked broken blocks into basement. Insurance paid for everything including remodel of basement family/rec room because of damage to interior wall/built ins. No damage above foundation. No issues after repairs were made.

2014 Equinox ~4,000 lbs.

Took out the pole and hit my house as you know. But even worse (or better if you are an shiny happy person), a neighbor in his newish BMW drove up that same hill and ran over the pole she knocked over! That took out his front end.

One of the responding patrol vehicles ran into the support cable too.

What a fiasco! I guess staying awake while driving isn't such a bad idea.

The bungalow down a street from my parents was smacked when two teenagers were street racing on the next street over. One of the racers saw a cop (because that street is where the police station is), freaked out, engaged in a high speed police chase, understeered off the road and plowed through their fence and front door.

They were repairing it for like a year, as it had huge foundation damage in addition to the fact that the car ended up taking out a wall, shifting the studs on another, and landing in their stairwell leading to the basement.

It is fixed now though.

I don't remember what the make of car was but it was probably something small like a Cavalier.

This is not the responsibility of your home owners insurance.

The Hitters insurance will pay.

Your HOI is for back up.

Hope you can get it all squared away with out to much hassle.

A reliable contractor will take care of all the permits, codes etc.

A discussion with a lawyer and the city engineer, or what ever he/she is called in your area would be a good idea.

Contact her insurance company and get things moving.

THIS. One of my buddies in high school had issues with people driving on and tearing up her parents' lawn, presumably because of how narrow their street was. Her dad found a contractor doing some nearby work and convinced them to bring over some large rocks left over from the job. The contractor put a few of them along the edge of her dad's lawn. Her parents never had trouble with people driving on the lawn again.

The reason you don't want to use your homeowner's insurance is that they wrote the insurance policy for their benefit and it will limit the amount and the type of damage you can recover. Those limits/disclaimers/exclusions don't apply when you go after the "at fault" party. Their insurance company will have to pay for all reasonable damages you incur because they don't have a contract with you, limiting what you can recover.

Having you go through your insurance company is a little game the insurance companies love to play. They do it all the time. Your policy limits and contractual restrictions minimize the amount the at fault insurance company has to pay. Sometimes it helps your company, sometimes it helps the other guys insurance, but it helps the at fault insurance company every time.

Ouch, that is not going to be cheap or easy to fix, but at least nobody got hurt.

I'm only here on account of a trucker over correcting just enough that he knocked down a full grown spruce tree in the yard instead of driving through my childhood bedroom that I was sleeping in at the time. So I can kinda relate.

Partially correct but.... In a third party liability claim they are only liable to the property damage limits of her policy. He would be paid on the depreciate value of the damage and they likely wouldn't be considering any code upgrades required.

The only limitation I could forsake in this case would possibly running into the code upgrade sublimit if it is low and it for some reason required extensive work to bring it up to code.
