Yes, it matters.

Yes, unfortunately it still does. Copyright law can easily come back to haunt us (and you), so we always make sure to dot our i's and cross our t's.

You also get bonus points for having a poor background that also includes people.

That background isn't crappy! I'm like 60% sure its North Park in Pittsburgh. I remember that car from a Steel Cities Region event, but I don't think it went to any of NHSCC events I went too when I still lived in Pittsburgh.

That issue comes up every now and then with us. For one, I see it as a basic courtesy. They own the rights, so is it okay for us to use the image? It could also become a legal issue, too. Could we fight it? Maybe. Do we want to spend the time and money doing that instead of other stuff? Nope. Here's how I look at it. If you buy a copy of the new Beatles cassette, do you have the rights to redistribute it? But yeah, keep those cards and letters coming.

Quick question, if I bought the photo from him, do I still need to get the permission? (Being a photographer I should know this but I'm a bit fuzzy on copyrights and purchased photos)

In reply to Jerry:

Yes (see my first question in the thread).

I just emailed the photographer and he gave me permission then I forwarded the email to David.

Would love to submit this, but somehow I don't think they would put it in a national magazine....

Cut out bumpers - Check.

People in background - Check................

Massive pink c**k on car - Check..................

Me having no idea friends are playing prank by putting said pink figure on my car and then giving thumbs up before race - Check .....................

Proceed to win race, wonder why corner workers are hooting and hollering, people staring at the car, and then being asked to go to race director since I am in trouble (having no idea why), then being showed said pink figure, panic strikes - check................

Being "talked to by event director and race director sternly", then revealed by them that they were part of elaborate prank just to get me - checkmate

Derp. Caffeine and a little more awake I read the whole thread again. Hope I can remember which one took my photo, there were 2-3 and it's been about 2 years. Hopefully by the end of the weekend I'll have my submission ready to go.
