Fell right in the seement pond at the Berkshire Mall.

Well, now she's suing.
Of course it wasn't my fault, had to be Bush's. Everyone pony up money and that will make it better.

While I don't think she's suing because she fell in the fountain, but because someone leaked the security video, I think a lawsuit here confirms she's a dumb bimbo.
In reply to Derick Freese:
Exactly, if she said nothing there are about 5 people in the world that would know that it was her in the video.
Now there are millions and they can link a name and face to the haha.
She was completely unrecognizable in the video, I assumed it was a teen. Prior to seeing her this morning on GMA, she could have walked into me while she was texting and I never would have recognised her.
Her lawyer needs to be dis-barred for taking the case. If he initiated it, he needs run out of the country.
edit: btw, that is the mall where we went when I was a kid. The fountain has been in the same spot for at least 30 years.

In reply to Derick Freese:
Correct, Derick!
Leaking and posting the video is the basis of the suit. Aside from privacy issues, there is concern over the security team failing to render assistance, but only if the stupidity was witnessed "live". And the maintenance guy wasn't exactly hustling to help or clean the slippery tile.
That she is dumb is a given; she walked into a pool AND then revealed herself to the public.
Perhaps we can give her a trip to the grand canyon. Then send her a text asking what her birthday is. Problem solved.
And the best part is that she works AT THE MALL. One might think that she would be aware of where the fountain is.
Even scarier: Last night while driving home I passed several people who were texting while driving.

Couple of weeks ago I was folllowing a woman up I-85 going about 5 mph under the posted limit. She was weaving off the right side, then would wander back across the left line. I was about to dial *HP and report a suspected DUI, but as I pulled up along side her as I was exiting, I saw she was texting away. She had been doing this for a couple of miles along the worst stretch of road around Greenville, SC.
It get's better, a reporter at the local paper found this.

he Reading woman who became an Internet sensation by falling into a fountain while sending a text on her cell phone was in Berks County Court on Thursday for a status hearing on theft-by-deception and related charges.
Cathy A. Cruz Marrero, 49, was charged in October 2009 for using a co-worker's credit cards to make more than $5,000 in purchases at two local stores....
Not a surprise that she is a scammer and an opportunist.

I usually don't have the patience, but I'm glad to see "What goes around, comes around".
I lived not 5 minutes from that mall for a few years. Many of the people there are really not much smarter than a box of rocks.. so this does not surprise me
Ok so not going to lie, I could totally see myself doing something like that (maybe not while texting, I am just good at doing stupid E36 M3) but to sue over it really?
Dood. Didn't you hear? That's how America works now. Do something stupid and embarrass yourself, then sue the people who allegedly laughed at you. No kidding, it happened when I worked at the Jeep place; a girl walked in the service drive on a rainy day, fell and landed on her ass. Four of us IMMEDIATELY went to her aid, the service manager asked if she needed a doctor, nobody was dumb enough to laugh. Four days later we got a letter from her attorney where she claimed we all laughed at her and refused to help.
If the true cases covered on this site don't make your blood boil, then you ain't paying attention.

The brief part of the interview saw could sink her case:
Inattentive Woman said:
I hoped no one saw me
If no one saw her, like she had hoped, how would anyone come to her aid?

should have called the cops. They'd atleast pull her over and run her through a sobriety test. She wouldn't pull that stuff again.
In CT, texting while driving is illegal.
I guess the woman is lucky the pond din't have water fountains or anything; tripping face first into 2" pipe nipples could mess up the rest of your day.

OK just to be the devil's advocate here. If you did something embarrassing and someone filmed the security footage and then posted it without your permission on the internet you wouldn't at least want to sue them? I mean ok people do dumb E36 M3 but technically the person who posted it without her permission is in the wrong.
In this case though since the video is in poor quality only the security people watching, and the people on the tape know who she is. But if you find out you're posted on the internet and over 2 million people are calling you a dumbass then even though they don't know who fell in the fountain you do. So it might hurt if your thin skinned to those kind of things.
Now looking at the woman's devious past makes me think it's all a "15 minutes" / "tryin' to get paid" scheme.

Really, "there is an App for that"
This lady should become the spokesperson for this product but instead she will likely just get it legislatively mandated.

Ever want to be a judge so you could throw cases like this out?
Even if were not in the wrong, I wouldn't want to go against Judge Judy!

The thing is, she has NO "reasonable expectation of privacy" in a public shopping mall. She's in public, she's a dumbass, the world is calling her out on it. The mall management may have a beef against the security company for violating protocol with the leak, but she doesn't have a leg to fall off of about HER privacy being violated, because she didn't have any in an open public venue.
I work just a few miles from the Berkshire Mall, so this story is the biggest thing going here.
The law suit would stem out of the release of the surveillance video. Her atty will claim that releasing it caused her emotional distress, etc... Besides doing auto claims, I also work with general liability claims such as slip and falls. This case is a bit extreme and unique, but we see things of a similar nature frequently.
There are red flags all over this. I would not at all be surprised if at the end she finally admits it was all staged. She has a prior record, owes lots of people lots of money, and a good look at the video gives clues that it was staged.
