And what does the security team rendering assistance have to do with anything? Sounds like that would be managements decision as to whether or not they were doing their jobs. If I was there, I wouldn't help the stupid twat either!

Nuisance suit. Shotgun lawsuits to anyone remotely associated; the mall, the security, the company that built the pool, the poor janitor that filled the pool, Verizon for the phone and on and on; they all want her to go away so they all pony up $100 each.

See how easy that was?

I simply noted the basis of a possible suit; never condoned it.

If you re-read my post, you'll see recognition of the possiblity the security tape may have been viewed and copied after the event. And, management cannot make a decision until it is informed......

On a side note, QWERTY phones dont help. Compared to a standard number pad, they require much more concetration.

I can do just about anything short of driving and text one handed with only occasional glances at the screen on my "ancient" RAZR. The short time I had with a QWERTY phone texting required my full attention.

Back on-topic, this stinks of scam.

I hope he has a good liability umbrella policy because I expect the lawyers for the mall to pin all the "emotional and embarrassment" claims onto him directly.

As a security guard he probably doesn't have any money and won't be named in the suit. Broke people don't get sued because the lawyers know they won't get paid their 33+%

Nonsense. I'm in three right now. People who sue after doing dumb things is nothing new. One of my friends is in a similar case. He was in a bus stop picking up passengers. Innocent victim was walking down the street watching a movie on his iPad. He fell off the curb and cut his head on the back of the bus. He is suing for 10mil.

For the most part they have stopped paying people to go away but they still have to pay a lawyer to defend the case and take workers invoved away from their job to testify so every one of these lawsuits costs us, and therefore the customers and taxpayers, a bit of money that it shouldn't.
