Just a thought: I have no idea what kind of business you're in, but if there's a way for the chronic absence/slacking to be considered an insurance issue by some stretch of the imagination, you MIGHT be able to get things fixed. In my experience, when the insurance provider or the risk mgmt dept says something needs to change, it changes remarkably fast, because NOBODY wants to explain to the CEO or the Board why the company's coverage was reduced/denied/messed around with in any way. Everybody hates the L-word ("Liability.")

One of my co-workers at one point had a job where smokers were allowed cigarette breaks and non-smokers did not have a similar allowance. He took to "smoking an imaginary cigarette" there. Same situation as you - management knew he was working hard and agreed to let him do that.

that is a good point. If these people are on the clock they are covered by the Business' insurance.
