i disagree with all of you and yes i think the Zoo is wrong. i see so many people doing this at exhibits. it was a terrible accident that should of never happened. the boy was saying "mommy i cant see pick me up" and in a second poor judgement lead to this. at the old zoo exhibit for the bears a kid i went to school with on a 3 grade field trip fell in he climbed up on the railing to look and fell over lucky for him they got him before the bears did.........when there are kids involved there should be no way anything like this could happen no matter how dumb the parent is

I've got an idea... how about the parent actually, I dunno, be a berkeleying PARENT and not throw your child over the edge? Just a crazy idea.

Those same kids can go to an amusement park and take their lap belts off and stand up. This is also dumb and can lead to a fatality.

Unfortunately that is exactly what cutter is proposing. Make everything in life "safe" for everyone at all times. I don't think he understands what that truly means though.

While I agree the parent should have known better, at the same time I see how the zoo could have designed the enclosure better. Not saying she has a right to sue, just that it could have been prevented either way.

I'm all for making the cages just barely tall enough for the animals to not be able to get out.

But make it EXTREMELY easy for people to get in.

IIRC I'm one of those heartless bastards who saw this coming too. I has no surprise.

There is also a lawsuit out there where some idiot was drinking beer in a National Forest, passed out in his sleeping bag and woke up at about 2AM needing to drain the lizard so he went stumbling through the woods. Our hero proceeded to fall down a 10 foot embankment and break his leg. And of course he sued the Forest Service for not putting up a rail.

I my perfect world, this is how she'd be treated now. Before was pity over the lost child, but suing for your own actions is far past what I can grasp.

I maybe agree.

The Zoo really should have designed an enclosure where any visitor can look in and see what is going on if they behave reasonably. That means kids need to be able to see in. That means, you need some combination of things like plexiglas viewing ports, reinforced mesh, or step ladders. There isn't enough information here if the Zoo had those things and the parents just ignored them.

If you dangle your kid over a wild animal enclosure, that's stupid. If you make it so that the only way for kids to see into your enclosures is for parents to pick them up and stand them on the railings, that's foolish too.

This doesn't mean, "remove anything that could possibly dangerous". It means, make it simple to safely do the normal things you would expect to do in the situation. If you decide to take off your seatbelt and not keep hands and arms inside the roller coaster car, that's your fault. If you don't tell people they need to be a certain height for the roller coaster, and the seats and belts aren't effective for kids, that is the park's.

I think we should see if she can sit on the railing without falling in to the dog enclosure. If she can, then she was negligible in not securing her child. If she falls in (yes, the dogs are in there) then she can sue, after she climbs out.

To be fair this is the Railing the boy fell off of. Does this look to be of a design sufficent to prevent human intrusion to the cage?

I'm not saying the mother was right for what she did however there is a large possibility the Zoo was negligent in the design of the enclosure/railing system. My understanding is that there are standards for this sort of thing related to setbacks, railing heights etc. to prevent this sort of thing. If this enclosure meet all those then the Zoo has minimal to fear in a suit.

I'm sure I will get labeled some sort of thing by those of you implying you'd like to sterilize or outright kill the mother for her wrongdoing. Irregardless of the zoo's action/enclosure design the mother was negligent for lifting her 2 year old up and putting him in that possition where a fall would have been possible. I really would only feel she is criminally responsible if there whre witnesses or some history that would show she may have "thrown" the child in. I would be ok with child endagerment however as she clearly endagered her child.

Yes, yes it does. But then again, I'm not stupid enough to put my child up there and let them go. I wouldn't be stupid enough to put my DOG up there. there is absolutely NO reason to put your child on the railing. At all.

The zoo has also removed the observation deck the boy fell from and re-landscaped the painted dog exhibit area, Ms. Baker said. But it hasn't put any new animals in that space.

BTW, I was wrong.....this story says she did NOT let go of the child.

The lion enclosure at our local zoo is basically like a large stone pit, and the viewing area is about 30 feet above it, with a fairly low railing. Pretty much anyone over the age of five COULD climb over if they wanted too, but you'd drop 30 feet into a lion den. So far no one has been dumb enough to do so yet.

i been there and have seen what they are talking about......SORRY BUT IT WAS DESIGNED WRONG......why would you have all of it protected by mesh and then leave one section open. you know how many parents i have seen put their kids up on that railing and let them hold on to that mesh and look down......the parents were good people she was not some drug addict. i will stand by my statement the ZOO is wrong. just look at the construction of the deck come on it looks like some hillbillys built it. i bet a lot of members have better looking gazbos than that.......
