She is competant and efficient. I can find no fault except that she apparantly smokes a fattie before work. Not a big drug smoker myself so I don't really know if it is an issue. Any opinions?

If you own the company and she's still performing as needed, then that's squarely your call.
If it were my company, i wouldn't care, but i may make a comment about her needed to spray something before she comes in so nobody else has to smell it.
If i found out she was dealing mass quantities of it, then maybe we'd have an issue, mostly because i'd have to be constantly planning on replacing her if she got pinched. But if it's just recreational use and she's still doing great at her job? Meh. Don't care.
Tell her to stop bogarting.

I don't drink either- but largely have the overall opinion that what people choose to do is their own business as long as it doesn't negatively impact others.
If it's that noticeable just from smell but not from her behavior or performance, it might be wise to just tell her that it is noticeable- she probably doesn't even realize it, I knew plenty of smokers who couldn't tell that they reeked of smoke but that non-smokers would be holding their nose at.

Ask if she has a prescription. If she does she's golden. I'm hoping for medicinal coke myself.
Did someone else give her a ride to work? If not do you detect the strong odor of marihuana often? If so have a discussion about unnecessary body odor.
After hours is not my business, but I don't want my accountant coming to work high and then working on my finances, whether it's on marijuana or anything else.

Since she's performing her duties perfectly, I'd just call her out on it--"please don't come to work smelling like weed".
Otherwise, it's no different than the millions of people who are on (legally prescribed) prescription drugs in the workplace.
Your call, but it seems like an easy situation to remedy.
If it was alcohol it would be a different conversation. I don't think you can tank up before work without it having an effect on your performance. But she is in an office by herself, it is pretty much as legal as nicotine in BC, and as far as I can see it has had no effect on her work. I guess I will just suggest that she ensures no one else has to smell it. And have her work audited for my own peace of mind.

Maybe her boyfriend smokes. I put my neighbor's kids on the bus a few mornings when Mom had to be in early, not a problem. These kids REEK of cigarettes, I know they weren't smoking them.

Yeah, this is just a discussion about body odor, then.
Years ago I walked by one of our company truck and it reeked of weed. I mentioned to one of the guys on the truck that they may want to air it out before parking it at the shop because it was very noticeable and the boss probably wouldn't like it. Two days later, both guys had a melt down in the bosses office claiming I was snooping through their truck. I never said anything to the boss about it but they believed I had ratted them out. They both quit.
In my view what you do on your own time is your business, but when you clock in it's my business. I would have a conversation about it.
Everyone here (especially being from the US) should realize the HUGE liability he is taking in by having someone intoxicated at the work place... right?
Whether you agree with the individual smoking or not is irrelevant.
And then to add my actual opinion, I'd never hire or employ someone who 1) did drugs 2) thought it was acceptable to come to work high irregardless of anything else. That falls under "lowlife trashy piece of garbage" type of individual. Much better people in the world around for the fruits of their labour the pieces of trash like that.

I get that. I also understand that there are ways this could impact others. If there are written policies that are being ignored, it is difficult to enforce any OTHER policies. If the reek of pot in the office causes you to loose clients, that's also an issue....
Alcohol is legal here, but you can't show up to work drunk.

I was watching wholesome cable programming (Andy Griffith Show – “gotta’ nip it in the bud”) last week with my two daughters (nine and six) and they kept playing a promo for a sit-com where the actor is at a party and says “I never mix booze with weed”. I took this as a signal that we’ve hit critical mass on the subject and as a result, I think a lot of questions such as the one you’re posing, will need to be addressed.

All i got out of this was "It's legal," unless nicotine is also illegal?
2) You wouldn't hire anyone that drinks beer outside of work anyways, so i'm not sure how relevant your thoughts are.
3) Highly unlikely that it's straight up illegal to be intoxicated at work in an office setting. But it's potentially against company rules/regulations, but that's not something that you or i can know for sure.

This. Back when I was in retail management, I used to tell my part timers one thing. "We don't test here. I don't care what you do when you're off my time. But when you walk in that door, you'd better be ready to bust your ass... if not I will punish you" and left it at that. One kid tested me, once. Bitched about his hangover and refused to work. He paid for it. No one wanted to deal with what he's got.

Actually, just calling her out about smelling like she just came from a Phish concert is probably a good idea. Even if you don't care, there are obviously people who might feel like she is a lowlife piece of garbage. Tell her to keep it on the down low.
