I do a fair number of minor surgical procedures in the office.  From time to time, people ask if they can record the procedure.  I figure, it is their foot, why not.  I guess there is potentially some downside to it, but I generally tell them yes.

What do y'all think?

As long as they’re not offered as a “how-to” vid, the only downside I see is if a patient thought it could be used as evidence in a malpractice suit?

What are they doing with the videos? Inviting family and friends to a party and out comes the surgery video. I’d rather see vacation vids.

The only thing that would concern me is HIPAA compliance - but it is their medical data so the law doesn't really say anything about what people do with their own medical data. I figure as long as you're not keeping a copy and they're not recording anyone else it would be OK.

I had arthroscopic shoulder surgery a few months ago, and the surgen gave me a video of it (without me asking) and encouraged me to watch it.  I was amazed at the number of people who said they would want to see it!

Hey doc, this surgery should only cost me about thirty bucks, i saw it on Youtube and it only takes five minutes.

Sounds risky.

Do you KNOW there is no other patient data on the video?  ANY possibility of something left out on the counter, patient walking by in the background, etc.?

How about where is it hosted?  Yes, it's their data, and it would be their choice to host it, etc.  But if your office name is shown, or your face is identifiable, or your name is spoken, and it is then hosted on an insecure site (like YouTube, or their iCloud automatic backup of their phone), you could get in a mess with HIPAA.

While I think some healthy risk awareness is good, I also think that you are the doctor and what you think is best for the patient is between you and them. It'd be an individual decision for me, case by case. And I would be careful not to be ridiculous, but remember that police officer video cameras help the officer's case just as frequently as they help the civilian's.

Headlines can always go the other way:

"Giant Health system x denies 5 year old cancer patient of videotaping her own surgery" or "doctor suspected of foul play after he makes patient delete videos of surgery"

Anyone see the show called something like "Doctor Pimple"  Just NO NO NO!!!!!!!!  after watching the 5th or 6th syst being drained it had to go.

I agree with this, and see no problem with videos. But I think it’s a matter of who controls the camera.

Offering videos of procedures to your patients as a service when you control the camera is smart business. Allowing patients to use their own cameras to film whatever they choose to is risky.

I once got my butt in a sling as a superintendent on a medical construction project. I included project pictures showing the construction progress in a report that had images of the patients in the background.  Didn’t even realize I had done it.   But it’s a HIPAA Violation.

Sounds a little like evidence in a malpractice suit to me.  But I'm neither a doctor nor a lawyer.

I just imagine that the one surgery out of 100 where someone complains, it could be a nightmare.

This is primarily people asking to video me fixing an ingrown toenail.  No potential HIPAA issues, is at most an occasional request and is sort of a case by case decision.  If I get a bad vibe, it is a no, but that has only been once.  My consent form actually has a release for me to photograph or video stuff.  I have a fair number of before and after photos, some of which you would definitely not want to see.

 

Draining abscesses is not so gruesome, as long as you don't have smell-o-vision on your I pad

Just, whatever you do, don't try to make music videos in the operating room and post them on Youtube. That one happened just a few miles from where I live, and made national news. It didn't help that some of the procedures went horribly wrong.
