I understand the transgender thing. You can't discriminate against someone based on their sex (gender), and there are a whole lot of grey areas with transgender individuals.
But that is still a law related to the physical sex (gender) of the person (even if it has changed, or is undergoing change).
Discrimination based on sexual orientation would be entirely different. It would relate to their private activities, not their physical characteristics.
The EEOC says lesbian, gay, and bisexual people may file a discrimination claim. They do NOT say such a claim is supported by Title VII.
I think they are fishing for a test case.
