Rutherford Institute to defend Marine arrested for Facebook postings
I don't have a FB account so I couldn't read his page. I guess it really does not matter what he said. This is some troubling E36 M3 on more than one level.

I'd have to hear just what was in these posts before I judge one way or another. Maybe innocent stuff, maybe he looked like the next military base shooter waiting to happen.
Found some details:

Mostly libertarian stuff, but he was also a "9/11 truther" and posted some revolutionary and gratuitously violent messages just before his arrest.

I don't think it matters. Obviously what he said was incendiary... but they didn't charge him. So it was not a direct threat or crime in that regard. Reading the content then, only adds emotion to a reasonably clear violation of rights.
The precedent that sets is right up there with assassinating american citizens without a trial because they are too hard to catch.
It's sad how widespread and pervasive surveillance is now (although it's partly people's own fault for using corporate-controlled/nonsecure social media) but that's another matter.
About his detention, if he was arrested by the police I agree it's outrageous, but if he was detained by the military through the police, that's a different thing.
Something else that bothers me, reading comments to this story on various websites reveals that everyone thinks this is a partisan problem, that this dude got arrested because the Republicans or the Democrats have ruined this country. Way to miss the plot. Neither party cares about your civil liberties.

That is handled by a local sheriff after commitment proceedings.

This is something I just don't get about people. What evidence is there that we should trust either party of Government? These guys are slimy at best, regardless of which side of the isle they are on.

Whose to say they did?
I'd guess that there are hundreds of middle eastern immigrants and followers of Islam who are arrested and detained on a regular basis for similar spoutings.

youre not "not arrested, but placed in handcuffs, and incarcerated against your will" when that happens...you go to a therapist by court order. If you fail to appear, then youre arrested for failure to comply.
The whole thing is THE FBI HAD NO AUTHORITY TO DETAIN HIM, OR EVEN ENTER HIS HOME...YET THEY DID SO ANYWAY!!!!. Even after his attorney pointed out, in no uncertain terms, that there was a clear and egregious infringement on his constitutional rights, the courts gave him even more "not a sentence" of 30 MORE days in an institution.
How can you try and rationalize this?
What if his pecker was swollen and it made him so angry he posted crazy stuff on teh intarwebz, and the FBI knew he needed a doctor to fix it so he could have kids one day, so they taked him to teh hozpitall to fix his weenie...ya know...for the children...think about the children!!1!
Maybe not ......

This is so true, sadly.

I've been saying for years, two sides of the same coin, bought and paid for by special interests.
This story, and those who see nothing wrong with it, are truly depressing.
A lot of it has to do with getting the bad guys. 11 years ago, we started a war on terror, and with that came a promise to never let anything like 9/11 (or the Oklahoma City Bombing) happen again. The problem is, many in national security immediately focused all of their attention on those of middle east descent or radical Islamic leanings. This was profiling, and it was wrong. Now that we've had a few white middle class loonies shooting up places, national security has realized that in order to fulfill its promise, it needs to look outside of a single ethnic group and maybe even at those who are supposed to the "safest".
There are probably hundreds of people detained every year on charges of hate speech and planning terrorism. You don't hear about it because they aren't ex-Marines.
I'm sure in most cases you say "we got the bastards before they did something horrible."

The main problem is the American people value security over freedom.
And for that, they deserve neither.

It also provides that when the president declares a state of emergency, Congress cannot review the action for six months.
And that was just some nonpartisan thoughts off the top of his head, not cut and pasted right wing talking points.

Do not put words in my mouth....Just because you think something, doesnt mean we all think that way.

Well its very easy for folks out in the country who have never met an middle easterner in their life to say "get the bastards." Then all of a sudden the government is peep'in them and its an "heavy hand of government."
So you have one of two choices:
Fight terrorism and intolerance abroad (Taliban, al-Queida, Islamic radicals, etc) by educating the citizens of developing nations.
or
Fight terrorism at home by telling people that hate is bad and you shouldn't get your feathers ruffled over conspiracies.
Both options are bad, but nobody wants planes flying into buildings or radicals blowing up Fed buildings.
EDIT: I'll add that I think there is a difference between arresting someone because they say something and watching them because they say something. If someone says "I'm going to blow up a building" then I think law enforcement has every reason to watch someone. If someone buys the materials to make a bomb AND they talk about blowing up a building, law enforcement has every reason to arrest someone.

+1000. This story brothers me greatly. I mean from what I saw he posted 9/11 conspiracy stuff and rap lyrics. When did that become a crime?
Not all crazy people are first amendment heroes. Some are just plain ole run-of-the-mill nutters.
