So I got pinched speeding on my way home. The cop was nice enough to knock it down to 45 in a 40. Still a $80 ticket all the same.

DE is funk in that if you haven't had any speeding tickets within 3 years and pay it off online there are no points assessed.

"A speeding violation of 1 to 14 mph over the posted speed limit will not be assessed points, IF (a) it is the first violation within any three (3) year period and (b) the ticket is paid through the Voluntary Assessment Center."

Now I did have a couple tickets more recently that were non-moving violations, it was not having a different car registered (yes I was being stupid let's move on). I'm not sure if that would count against the above mentioned law, and nothing is really clear on stating if it is.

The $80 is worth not spending a day attempting to fight it, but I'm trying to figure out if I'll have points assessed which would ding my insurance obviously.

can't say for De. but here I'm betting if I showed up pre-court with a 5 over speeding ticket the DA would throw it out just on principle ..

I seriously doubt that. Tickets are all about the money, they may offer to change the offense to a non moving violation , but I've never seen a ticket thrown out before it went to the judge. I've also never seen a DA involved in traffic court cases, its usually the cop and his supervisor that will offer a "plea to a lesser offense" deal before trial, unless the cop wants to stick it to you.

I've had a couple ... one time the DA actually asked (rhetorically) what the berkeley was that troopers problem ? and told me to get out of there ( as he was doing with the other 40 - 50 people the trooper had ticked for the same "offense"

and here ( the last time I had to show up ) there was a sorta pre-trial window with assistant DA's manning the window ... you could pay, ask for dismissal ( if your reason was good enough), ask for prayer for judgement, etc ... some times you'd get sent on to court, sometimes it'd be handled right then ... one way or the other

On another note, what part of Delaware do you live near, north or south?

New Castle, work on Kirkwood HWY, if you see a Red Scirocco II or Winning Blue NC Miata it's me. Not exactly inconspicuous cars.

I want to say we've had this discussion before...

I opted to pay it off, then enrolled in an online Defensive Driving course just in case to give me the 3 point credit. If nothing else the 10% insurance drop will be worth it.

Here the prosecutor changes them to a non moving violation if you pay on the spot. My wife averages a $250 parking ticket a year

On the showing up and fighting it in court front (I know you aren't doing it), I've had an officer knock a ticket down to 10 over. He guaranteed me that he would be at court that day, and that if I showed up, he'd tell the judge exactly how fast I was going.

I think that if you got a ticket for 5 (or possibly even 10) and were only going 5 (or 10) over, then it would be worth fighting. If they knocked it down TO that, pay the ticket.

Had I known about it before committed to DelVal Miata to do their Jersey Shore charity cruise I would have.

Is there a posting of when the next AutoX will be? Keene is a very easy drive to get to. And I sure could use the practice.

Often times 5 mph (depending on the method the speed was captured) may be thrown out. I wouldn't waste my time finding out. Pay your $80 and move on. The only reason I would go to court would be to avoid points. Apparently you don't have to worry about that.

Mind telling how fast you were actually going? Most cops I know don't ticket until about 12+ over. They have better things to worry about, though.

He pegged me for 63, I have a dashcam app running when I'm in the car so I got to watch my own stupidity over and over. I went to go around another car and shot up to speed literally right in front of the cop on the other side of the street. Just a royally dumb move.

I think the fact that I pulled over into an empty parking lot as soon as he turned his lights on helped ease my penalty. As soon as he came up to me he told me he was giving me a ticket but he was going to cut me a break before he even had my license and registration.
