Now her is trying to screw her again by re-appearing.
The judge should uphold the death by enforcing it.

Well if he gets it overturned, his exwife would have to pay all those benefits back, and presumably he would get them, but maybe could also be held responsible for the $26,000 in child support . I don't know how a judge could uphold the death though, given he is clearly living. Regardless of any dick moves he may or may not have done. He is not dead and can't/shouldn't have his legal status be dead.
Of course, being dead he has no civil rights. 
If he's dead, then he no longer has to pay taxes right?

they will find ways to tax a dead person.. and dead people are still allowed to vote in some areas, so he's still got some rights.
Lal Bihari from Uttar Pradesh found out that in 1976 he was declared dead. After this discovery he had to struggle for years to get the government to recognize that he was still alive. Revenue officials ignored him, so he tried a number of drastic steps to be recognized by the government. This included passing out leaflets, running for office, insulting judges and public officials, organizing his own funeral and demanding a widow's pension for his wife. He even went so far as kidnapping, threatening murder, and other attempts to get arrested, just so his name would have to appear on the books. Why did this happen? As Bihari found out, he was a victim of a not-too-uncommon practice in his home district of Azamgarh, which is overcrowded and where competition for land is fierce. Relatives of landowners (in Bihari's case, his uncle) can declare their relatives dead in the Land Registry Office and inherit their property. Bihari met at least 100 other people who fell victim to the same scheme, and founded an organization called "The Association of the Dead" to fight on behalf of people who were wrongfully declared dead. Since finally having his official death annulled in 1994, Bihari has dedicated his time to protecting people in similar circumstances. He also has taken on the title "Mritak" so his full name is now Lal Bihari Mritak or "Lal Bihari the Dead".

Since we've long gone to convicting inanimate objects of crimes, (Maryland vs a Ford Thunderbird was the landmark case), charging and convicting a dead man should be a snap.
That said, being declared dead yet reappearing isn't all that novel. The article is carefully clipping facts to make a sensational story.

He's going about it wrong...
He can now be "undocumented", that's even better than being a live citizen.
In many states he'll get more benefits as an undocumented alien than if he's an alive citizen.
So sad, yet so true.
That's my retirement plan. Become a citizen of another country, then return as an alien and reap the benefits!
I am planning on becoming a citizen of another country.. but no way I am coming back. Malta is -very- nice
